Summary Explanation/Background
Many provisions of the Broward County Code of Ordinances (“Code”) have not been substantively updated since their original enactment, despite intervening material changes in circumstances, policy, or law. One example is certain provisions in Chapter 15 of the Code were enacted almost a century ago, when the County regulated items such as the sale of unpasteurized milk and meat products-topics now preempted to the State of Florida. Updating outdated provisions and repealing obsolete provisions will help avoid public confusion and will formally remove obsolete provisions from the published Code.
This item, if approved, would direct the Office of the County Attorney to prepare Ordinances to amend or repeal outdated or obsolete provisions of the Code and present such Ordinances, upon their development, for future consideration by the Board. Due to the large number of code provisions at issue, we preliminarily estimate that this project will take 12 to 18 months to complete.
