Summary Explanation/Background

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On December 14, 2014, the Claimant, a former bus operator, sustained injuries during the course and scope of employment with Broward County Transit Division. The Claimant alleged injuries to the back while operating a County bus that was struck on the driver’s side during a scheduled passenger stop.

 

Through negotiations with the Claimant, a settlement was reached in the total amount of $90,000. This amount is broken down as follows: (1) The Claimant will receive $59,500 plus $500 for a General Release and Resignation Agreement; and (2) the Claimant’s attorney will receive $29,950 for fees and $50 for costs. The settlement includes all past and future indemnity benefits. The entitlement to medical benefits will remain open.

 

Exhibit 1 is the Legal Sufficiency Memorandum signed by the Office of the County Attorney on January 8, 2020.
