Summary Explanation/Background

On September 21, 2021, the Board approved certain consumer protection regulations to make it unlawful for a private parking facility to issue a ticket for parking fines or penalties to a vehicle parked in a private parking lot. The industry has requested certain modifications to the regulations, such as to clarify that clearly posted collection fees for nonpayment of parking fees are permitted, provided that no document purporting to be or resembling a government-issued ticket or citation is issued.  This item, if approved, would direct the Office of the County Attorney to prepare any necessary amendments to the Broward County private parking regulations regarding nongovernmental issuance of failure to pay notices for vehicles on private property or private lots.
