Summary Explanation/Background

Senate Bill 484 (Chapter 2026-65, Laws of Florida), effective July 1, 2026, expressly recognizes local governments’ authority to regulate large-scale data centers through comprehensive planning and land development regulations. Given the potential impacts of these facilities on infrastructure capacity, utility demand, surrounding land uses, and the environment, the proposed Motion directs the County Attorney’s Office to draft an Ordinance establishing a temporary, one-year moratorium on the development of large-scale data centers, as defined in Section 373.203(4), Florida Statutes, within unincorporated Broward County. The moratorium would provide the County with an opportunity to evaluate these impacts and develop appropriate land development regulations governing such facilities.
