Why Action is Necessary

Interlocal agreements of this type require approval by the Board and governing body of the Municipality after two additional one-year terms have already been approved per Section 4.2 of the agreement, “Extensions”.

Summary Explanation/Background

THE MOBILITY ADVANCEMENT PROGRAM’S ADMINISTRATION RECOMMENDS APPROVAL OF THE MOTION.

The City of North Lauderdale (City) entered into an interlocal agreement on May 10, 2021, to deliver a surtax-funded municipal capital project that was recommended by the Broward Metropolitan Planning Organization’s Surtax Services for a design-phase in Cycle 1 (Fiscal Year 2020). The design for the project known as NLAU-007.2, was expected to be completed by March 2022. Subsequently, a portion of the project to be designed was impacted by severe road flooding, requiring the City to conduct drainage and stormwater assessments. On February 9, 2022, the City formally requested a scope modification to the County Administrator based on a stormwater masterplan and grant funding from a non-surtax source to address road flooding on a portion of the originally intended design scope. The County formally approved the scope modification on February 23, 2022. The First Amendment effective in March 2022 extended the term through December 30, 2022. The City later requested additional time to complete the tasks of removing portions of the project from the original scope, requiring a Second Amendment through August 28, 2023. The City requested a Third Amendment on August 14, 2023 through March 30, 2024, due to delays experienced based on the amended scope of the project. The City requested a Fourth Amendment on February 21, 2024, through August 31, 2024, due to determinations from the Consultants indicating originally proposed round-abouts could not be sized adequately to control traffic within the roadway boundaries, and other options for traffic calming needed to be explored. On August 13, 2024, the City requested a Fifth Amendment through August 20, 2025, to finalize design documents and allow enough time for review and approval by outside regulatory agencies.

The City is expected to approve the Fifth Amendment on September 10, 2024.
