Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work, and visit.”
In response to ongoing cybersecurity threats, this grant will enhance the Port’s security posture and further support Broward County’s broader initiatives to protect vital data and to secure critical network infrastructure at Port Everglades. It will safeguard the Port’s data and systems, ensuring a secure environment for tenants, customers, and the surrounding community.
On April 25, 2024, the Port Everglades Department applied for the Florida Local Government Cybersecurity Grant (“Grant Program”) administered by the Florida Digital Service (“FLDS”) within the Department of Management Services. On May 12, 2025, Port Everglades staff was notified that the Port was selected for participation in Round 2 of the Year 2 Florida Local Government Cybersecurity Grant administered by FLDS (see Exhibit 1).
Port Everglades will receive licenses, through a State-selected provider, for certain cybersecurity solutions. This grant will continue to support cybersecurity initiatives for endpoint-based asset discovery, network-based asset discovery, external-facing asset discovery, endpoint detection and response, and security operations platform, including software and services associated with the Port’s Security Operations Center.
This grant agreement requires approval by June 12, 2025. The FLDS has indicated that software access will be granted on June 27, 2025, before the grant expires.
The proposed grant agreement is on the required form of the State of Florida Department of Management Services and contains nonstandard terms, including a right of termination by the state for County’s failure to implement the solutions; a requirement that the County indemnify the state from claims arising from intellectual property infringement; a requirement that the County notify the state within 24 hours of a data breach of certain data, and that the County is responsible for all costs associated with a breach of its systems; and a requirement that the County cooperate with and provide assistance to the state’s incident response support.
The proposed grant agreement has been reviewed and approved for legal sufficiency by the County Attorney’s Office.
