(WSP) for Transit Systemwide Study, Planning, and Preliminary Design (RFP No. TRN2120307P1), increasing the maximum not-to-exceed amount by $3,000,000 (from $17,095,000 to $20,095,000) and extending the term for 24 additional months, from March 8, 2027, to March 8, 2029; authorizes the Mayor and Clerk to execute the amendment; and authorizes the County Administrator to take all necessary administrative and budgetary actions to implement the agreement as amended.

Why Action is Necessary
County Commission approval or delegation of authority is required to approve amendments to agreements in excess of the award authority of the Director of Purchasing provided for in the Broward County Procurement Code.

Summary Explanation/Background
THE TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the County Commission’s Connected Community Goal of “Cooperatively Creating an Efficient and Accessible Regional Intermodal Transportation Network”.
Broward County Transit (BCT) and WSP USA, Inc. entered into an Agreement for WSP to support the development of a premium transit network and provide preliminary engineering and design-up to 30%-for a Bus Rapid Transit corridor and a rail corridor. The Agreement also authorizes WSP to provide project management and technical support to supplement County staff across planning, coordination, engineering/design, construction specification development, bidding document preparation, PD&E/NEPA document review, multimodal feasibility study review, and bid/award support.
To date, WSP has supported development and adoption of the PREMO plan and is assisting the County in meeting Federal Transit Administration (FTA) requirements for the Capital Investment Grants (CIG) New Starts program and the associated BCR South grant application. County is internally progressing preliminary engineering and design, up to 30%, for the Oakland Park Boulevard BRT project, the West Broward Intermodal Center project, and branding for the PREMO program.
Due to unexpected delays in the FTA’s review of CIG New Starts documentation and changes in state law relating to lane repurposing for transit projects, project activities remain ongoing and will extend beyond the current contract expiration date of March 8, 2027. Additionally, should this item be approved, WSP will be tasked with developing the conceptual plan (up to 30% design) for the recently prioritized West Broward Intermodal Center project. To continue necessary support during the FTA grant review process for BCR South, complete 30% design for the Oakland Park Boulevard BRT and West Broward Intermodal Center projects, and finalize PREMO branding activities, an additional $3,000,000 in maximum not-to-exceed funding capacity and a twenty‑four‑month extension are required.
The County is preparing new solicitations for subsequent implementation of the BCR South, Oakland Park Boulevard BRT, and West Broward Intermodal Center projects. Extending the current Agreement will support a smooth transition of knowledge from WSP to future consultant teams engaged through these solicitations.
The proposed Sixth Amendment has been reviewed and approved for legal sufficiency by the County Attorney’s Office.

Sufficient Transportation Surtax funding has been appropriated in prior Fiscal Years for the activities described above to support the additional $3,000,000 in contract capacity. No additional budget appropriation is requested by this item.
