A. MOTION TO APPROVE Public Transportation Grant Agreement (“PTGA”) between Broward County and Florida Department of Transportation (“FDOT”), under the Florida Seaport Transportation and Economic Development (“FSTED”) Program, PTGA 444884-1-94-04, with FDOT agreeing to grant up to $40,000 to Broward County, but no more than 75% of the total eligible cost of the Project, and County agreeing to pay $13,333 and cover any Project cost overruns for Traffic Variable Message Boards, and Addendum thereto modifying the indemnification language of the PTGA; authorize the Mayor and Clerk to execute the PTGA and Addendum; authorize the County Administrator or designee to take the necessary administrative and budgetary actions resulting from approval of the PTGA; and authorize the County Administrator to approve any amendments to the PTGA that do not increase the County’s local match percentage (25%), subject to review by the Office of the County Attorney for legal sufficiency.

B. MOTION TO ADOPT budget Resolution within the Port Everglades Capital Fund to recognize additional grant revenue to support this capital project.

Why Action is Necessary
Broward County Board of County Commissioners (“Board”) approval is required for the execution of the PTGA and Addendum, and to recognize additional grant revenue.
What Action Accomplishes
Execution of the PTGA and Addendum provides funding to purchase Traffic Variable Message Boards to assist with the safe and efficient flow of traffic at Port Everglades. The County Administrator is delegated authority to take the necessary administrative and budgetary actions to implement the PTGA and to approve any future amendments to the PTGA that do not increase the County’s local match percentage greater than 25% and allocates grant funds withing the Port Everglades Capital Fund.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
On October 25, 2023, the Florida Seaport Transportation and Economic Development Council (“FSTED”) approved the allocation of state funding for seaport security initiatives at Florida seaports. The allocation included $40,0000 in grant funding for Port Everglades (“Port”) to purchase several mobile traffic variable messaging boards to improve communications with Port users at targeted access control points or other locations within the Port. The Port has several construction projects currently underway or beginning within the next year that will affect traffic management within the Port's boundaries, some that will require changes to existing traffic patterns. With almost four million cruise passengers passing through the Port each year, over 1,200 petroleum tank trucks per day and hundreds of other vehicles operating on the Port each day, the ability to rapidly provide information, directions, and changes in traffic conditions to Port users is essential to maintain efficient operations.
The signs will also be used to provide information to arriving vehicles on access control procedures, improving the efficiency of vehicle screening, and reducing congestion at the security checkpoints. Rapidly programmable and moveable, the mobile signs will allow for the Port's security staff to modify the messages to address areas of concern, or to move the signs from the entry checkpoints to other locations within the Port to address emergency issues that may arise.
A requirement for this funding is to execute this PTGA between FDOT and Broward County prior to disbursement of any funding. This PTGA is written in the standard FDOT format and includes an Addendum modifying the standard FDOT PTGA indemnification paragraph to remove the word “defend” in accordance with Sections 725.06 and 725.08, Florida Statutes, to reference Section 768.28, Florida Statutes, and to state that nothing in the paragraph constitutes a waiver of sovereign immunity. FDOT will execute the PTGA and Addendum after Board approval. The PTGA and Addendum have been reviewed and approved as to form by the Office of the County Attorney.
