A. MOTION TO ADOPT Resolution providing funding for certain services, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, AUTHORIZING APPROPRIATION AND DISBURSEMENT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT GRANT FUNDS IN THE AMOUNT OF $12,809,787 AND A BROWARD COUNTY MATCH CONTRIBUTION OF $2,732,603 FOR AN AGGREGATE AMOUNT OF $15,542,390 FOR FISCAL YEARS 2025 AND 2026 TO EXISTING SERVICE PROVIDERS FOR THE PROVISION OF SERVICES TO INDIVIDUALS AND FAMILIES EXPERIENCING HOMELESSNESS; AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE A NEW AGREEMENT WITH A SPECIFIED SERVICE PROVIDER AND TAKE ALL NECESSARY ADMINISTRATIVE AND BUDGETARY ACTIONS TO IMPLEMENT THE AGREEMENTS; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
B. MOTION TO ADOPT budget Resolution in the Housing and Urban Development (“HUD”) Continuum of Care Fund in the amount of $15,542,390 for supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.
C. MOTION TO ADJUST personnel cap to 6,835 positions to add one new grant-funded position within the HUD Continuum of Care Fund. The position will provide operational and administrative support to Broward County’s Continuum of Care programs.
D. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item:

Why Action is Necessary
A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for existing agreements with external agencies and to authorize the County Administrator to execute a new agreement.
B. Section 129.06(2)(d), Florida Statutes, requires a budget Resolution to recognize revenue.
C. Section 20.8(b), Broward County Administrative Code, requires Commission approval to increase the personnel cap.
D. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.
What Action Accomplishes
Approval of Motions A, and B, provides continued funding for supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to operational and administrative expenses.
Approval of Motion C provides one new grant-funded position within the HUD Continuum of Care Fund.
Approval of Motion D waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” Funding supports one new staff position and continued funding for supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.
On September 5, 2024 (Item No. 10), the Commission approved the submission of the Broward County grant application to HUD to continue funding the existing continuum of care projects for the provision of supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.
Commission approval is requested for appropriation and disbursement of HUD grant funds to specified providers (Exhibit 1). Broward County is responsible for providing a HUD-required match for all projects listed on Attachments A and B (Exhibit 1, Attachments A and B).
Existing agreements with the service providers identified with an “R” in Exhibit 1, Attachment A, will be renewed in accordance with the terms and conditions of the agreements. The new service provider agreement identified with an “N” in Exhibit 1, Attachment A, will be in substantially the same form as the applicable standard form agreement approved by the Commission on September 5, 2024 (Item No. 7), and will be reviewed and approved as to form by the County Attorney’s Office prior to execution by the County Administrator.
The new grant-funded position is needed due to the transfer of the HUD grant project titled 100 Units Shelter Plus Care (S+C) from the Broward County Housing Authority to the County that was approved by the Commission on April 22, 2025 (Item No. 7). The position will be paid through the HUD grant administrative funds provided for new applicant processing, annual inspections, and annual income reviews and recertifications for all program participants .
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires a two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion D) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 4 and constitute full disclosure of any existing conflicts.

The total HUD appropriation is $15,542,390 which includes $12,809,787 in HUD funding and a $2,732,603 cash match from Broward County. Employee salaries currently included in the Human Services Department budget are used to meet the match requirement. These funds are currently available in the Human Services Department budget.
