B. MOTION TO AUTHORIZE County Administrator to approve and execute amendments to agreements with the service providers specified in Exhibit 1, effective October 1, 2025, subject to legal sufficiency review and approval by the County Attorney’s Office, to add mental health services, at no cost to Broward County, to street outreach programs for individuals and families experiencing homelessness in Broward County, and if necessary to ensure compliance with recently enacted legislation.

 

C. MOTION TO AUTHORIZE Human Services Department Director or Deputy Director to approve and execute amendments modifying the scopes of certain grant-funded agreements and, if necessary, to ensure compliance with recently enacted legislation, provided (1) the Director or Deputy Director determines the resulting modifications will not significantly alter the scopes and are in Broward County’s best interest; (2) the amendment does not increase the County’s total costs under the applicable agreement; and (3) the amendment is subject to legal sufficiency review and approval by the County Attorney’s Office.

 

D. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item:

What Action Accomplishes

Approval of Motion A authorizes Broward County to update various outcome measures.

 

Approval of Motion B authorizes Broward County street outreach programs to provide mental health services.

 

Approval of Motion C authorizes the Human Services Department Director or Deputy Director to approve modifications that will not significantly alter the scopes of certain grant-funded agreements.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND THE APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.”

 

The Housing Options, Solutions, and Supports Division (“HOSS-D”) requests approval of Motion A to authorize the County Administrator to revise outcomes for specified programs, as some outcomes were deemed not measurable, unattainable, and/or not impactful. Additionally, approval of Motion B authorizes the County Administrator to add mental health services to the programs specified in Exhibit 1 to better serve individuals and families experiencing homelessness in Broward County.

 

HOSS-D, in conjunction with multiple service providers, identified a need to address program outcomes that did not align with service program operations. Additional outcomes were reviewed to improve data quality in other programs. All changes were completed in consultation with service providers and other members of the continuum of care.

 

HOSS-D requests Commission approval of Motion C to provide the Human Services Department (“HSD”) Director or Deputy Director with the authority to approve and execute amendments to HSD Unit of Service Funding Agreements (awarded pursuant to Chapter 23, Part II, Broward County Administrative Code) when modifications are necessary to align program operations with contractual intent or practical implementation needs. The authority is limited to amendments that do not significantly alter the scope of services, remain in the best interests of Broward County, and do not increase the County’s total costs under the applicable agreement. All amendments will remain subject to legal sufficiency review and approval by the County Attorney’s Office.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion D) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 2 and constitute full disclosure of any existing conflicts.
