Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards and authorize the execution of associated contracts with a value of more than $500,000, inclusive of the value of any renewals or extensions provided in the contract.

 

Pursuant to Broward County Procurement Code Section 21.27, Purchases from Other Government Contracts, the Director of Purchasing may purchase goods or services under any procurement contract held by a governmental agency or nonprofit entity, or the County may enter into its own contract with the vendor under the originating contract provided that the originating contract was competitively procured, authorizes such purchases, and the terms offered to the County do not materially deviate from the originating contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development did not reserve this project for Small Business Enterprises or assign County Business Enterprise participation goals based on obtaining services through a preexisting contract with a non-Broward County agency (Exhibit 2).

 

This contract provides for the installation, operation, maintenance, and repair services of traffic sensors at Port Everglades, utilizing the Florida Department of Transportation (FDOT) Contract No. BEF74, Statewide Continuous Count Station Installation and Maintenance.

 

FDOT issued a competitive Request for Proposals (RFP) No. DOT-RFP-23-9053-SD on March 11, 2023, the RFP opened on April 3, 2023 (Exhibit 3). On June 7, 2023, FDOT awarded agreement BEF74 to Southern Traffic Services, Inc. for an initial six-year term, with one three-year renewal period (Exhibit 3).

 

The Port Everglades Department requests approval to utilize the FDOT agreement BEF74 to provide for continuity of services for the installation, operation, maintenance, and repair of existing traffic sensors (Exhibit 4).

 

The County Attorney’s Office has reviewed the terms and conditions of the agreement. Permission to utilize the contract was granted and resulted in the execution of the Participating Addendum with Southern Traffic Services, Inc. (Exhibit 1).

 

The initial term of the open-end contract will begin on the date the Participating Addendum is signed by all parties.
