Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) approval is required for agreements with external agencies.

 

B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

 

What Action Accomplishes

A. Approval of Motion A allows Broward County (“County”) to amend the Agreement with Broward Behavioral Health Coalition, Inc., (“BBHC”) to allocate funding for OCP4 services, authorizes a funding increase through use of underutilized funding in the amount of $56,671 to be carried over from Fiscal Year 2025 to the Fiscal Year 2026 OCP4 budget and an increase in the total amount of the County’s in-kind match requirement from $16,851 to $16,959 for OCP4 services, and updates the Agreement requirements.

 

B. Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The First Amendment enables the allocation of funding, increases Broward County’s in-kind match contribution, uses underutilized funds, and modifies the Agreement by including requirements from the grant renewal and updating the operational requirements for the OCP4 program.

 

On March 17, 2023, the Human Services Department (“HSD”), in collaboration with BBHC, applied to the U.S. Department of Health and Human Services, Substance Abuse and Mental Health Services Administration (“SAMHSA”) for OCP4 funding. The OCP4 funding supports the goal of achieving youths’ mental health wellness while keeping them in the least restrictive environment, with support and participation from their families. On September 14, 2023, SAMHSA issued a Notice of Award (“NOA”) for OCP4 services in the two-year federal grant amount of $2,000,000, effective September 30, 2023, through September 29, 2025, with two one-year renewal periods.

 

On December 12, 2023, (Item No. 12), the Commission approved the Agreement between the County and BBHC and adopted the budget for OCP4 services. The two-year OCP4 services aggregate amount of $2,701,702 included a $33,702 in-kind match from the County, and a $668,000 external match from the Children's Services Council of Broward County. OCP4 services are administered by the County, while subrecipient BBHC provides oversight and coordination of services under the Agreement with the County.

 

On February 4, 2025, HSD, in collaboration with BBHC, applied to SAMHSA for renewal of the grant to provide continued funding for OCP4 services to assist with building sustainable cross-systems infrastructure and evidence-based services capacity to improve mental health outcomes for children ages four through 11 years who are at risk of or have Serious Emotional Disturbances, and their families, with emphasis on underserved and minority populations. SAMHSA issued a NOA renewing the grant on September 16, 2025.

 

This First Amendment (Exhibit 1) seeks to allocate funding to the OCP4 services and increase the County’s in-kind match requirement from $16,851 to $16,959 as outlined in the NOA issued by SAMHSA on September 16, 2025 for OCP4 services in the one-year federal grant continuation amount of $1,000,000, effective September 30, 2025, through September 29, 2026 (Exhibit 2). The grant renewal also continues an external match from the Children’s Service Council of Broward County in the annual amount of $334,000. On December 16, 2025, the County submitted a notification to SAMHSA in the Federal Financial Report (FFR) of the carryover of unutilized grant funds in the amount of $56,671 from the Fiscal Year 2025 to Fiscal Year 2026 OCP4 budget to allow OCP4 services to be provided to additional eligible youth. The notification was acknowledged and approved by SAMHSA and includes an amount of $2,336 of operating cost to be allocated to the County, with the remaining $54,335 to be used to serve an additional ten eligible children.

 

The First Amendment (Exhibit 1) has been reviewed and approved for legal sufficiency by the County Attorney’s Office.

 

Retroactive approval is requested due to the delay in receiving approval from SAMHSA to carry over funds from the Fiscal Year 2025 budget to the Fiscal Year 2026 budget. Funds are anticipated to be used completely prior to September 29, 2026.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached to this report as Exhibit 3 and constitutes full disclosure of any existing conflict.

Fiscal Impact/Cost Summary

The budget adopted by the Commission on December 12, 2023, (Item No. 12), provides authority for the administrative action to include the in-kind match of $16,851. The current NOA increases the County’s match requirement to $16,959 and allocates an external match of $334,000 for a one-year renewal period total value of $1,350,959.

 

In addition, the OCP4 services aggregate total amount of $56,671 from the Fiscal Year 2025 budget will be available in the Fiscal Year 2026 SAMHSA OCP4 Grant Fund. The amount includes $54,335 for BBHC and $2,336 of operating costs for the County.
