Why Action is Necessary

Board action to accept a conservation easement is authorized by Sections 125.01(3) and 704.06(3), Florida Statutes, and necessary to fulfill the requirements of Environmental Resource License (“ERL”) No. DF01-1031, issued pursuant to Chapter 27 of the Broward County Code of Ordinances.

 

What Action Accomplishes

The action provides for the perpetual maintenance and conservation of the mitigation site by the grantor.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.

 

On March 12, 2001, the Public Works and Environmental Services Department (“PWESD”) issued ERL No. DF01-1031 (see pages 15 through 39 of Exhibit 1), to Calvary Chapel Sawgrass (now known as The Local Church, Inc.).  ERL No. DF01-1031 required a 0.24-acre multi-habitat wetland mitigation area with native wetland vegetation to establish a viable wetland.  ERL No. DF01-1031 also required the licensee to convey a Deed of Conservation Easement to the County over the area as shown in pages 23 and 24 of Exhibit 1 to ensure it will remain in perpetuity and be maintained by the grantor. On August 20, 2001, ERL No. DF01-1031 was modified to expand the mitigation area to 0.33 acres.

 

The Deed of Conservation Easement was reviewed and approved as to form by the Office of the County Attorney.
