Why Action is Necessary

Board action is required to grant authority to the County Administrator to execute Satisfactions of Mortgage in certain instances that are not currently provided for in the Broward County Administrative Code.

 

What Action Accomplishes

This action will allow County to satisfy mortgages recorded against homes that were repaired by the Pompano Beach Residential District Advisory Board (“RAB”) Pilot Program Round I to be consistent with the Program guidelines in Round II.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s vision of, “offering sustainable, compatible, innovative housing options for all income levels, including integrated, permanent supportive housing and repaid rehousing,” and its corresponding goal to “strengthen stakeholder partnerships to increase the availability of affordable housing of all types (e.g., rental, purchase, supporting, etc.) countywide, in every community.”

 

On September 21, 2021 (Item 57), the Board approved a pilot project for home repair work on 26 homes in the residential area of the Northwest Pompano Beach Community Redevelopment Agency (13 homes in each of Municipal Commission Districts 4 and 5), which was the first step toward the County’s $10 million investment to address slum and blight in that residential district.  The Board action authorized the County Administrator to take all budgetary and administrative actions necessary to facilitate the Pilot Program, and provided specific direction on the parameters of the Pilot Program (such as the number of homes, the maximum project cost per home, and the strong preference for local contractors).

 

On November 4, 2021 (Item 62) the Board waived Broward County Procurement Code to the extent necessary and directed the County Administrator to award the contract to administer the home repair pilot project to the Collective Community Initiative, LLC (“CCI”).

 

On October 11, 2022 (Item 23), the Board approved the First Amendment to the Agreement with Collective Community Initiative, LLC (“CCI”), for the purpose of increasing the funding by $163,800 to an amended maximum total of $594,050.  Under the terms of the First Amendment CCI was authorized to submit requests for payment for the full project cost when accompanied by an approved scope of work, fully executed mortgage and promissory note and homeowner/contractor agreement.  After the funding was released to CCI, some of the contractors did not complete the projects according to the scope of work, and some contractors did not complete the projects at all.  This action prompted CCI to enter into an agreement with a third party to take over the incomplete projects and to start the remainder of the projects.  The new vendor has since completed the assigned projects.

 

The Board authorized the County Administrator to administer a competitive procurement to secure vendors for Round II for the Home Repair Programs in the Pompano Beach Community Redevelopment Area (“CRA”) Northwest District (Exhibit 1) at the March 21, 2024, meeting (Item 25). In alignment with the goals of the RAB, the County released Round II of the funding. By contrast with what was done with the pilot program, where homeowners signed a five-year mortgage, homeowners participating in the second round are only required to sign a one-year Grant Agreement.

 

This motion requests the Board authorize the County Administrator to execute satisfactions of recorded mortgages and notes against the homes that received funding under the Pilot Program.  This will put the Pilot Program participants in the same position as those in second round of funding, currently underway, whereby the homeowners do not sign a five-year mortgage and note and instead sign only a one-year Grant Agreement.
