C. MOTION TO AUTHORIZE County Administrator, or County Administrator’s written designee, through September 30, 2026, to approve and execute future revocable license agreements between Broward County and any municipality requesting the installation of School Zone Speed Detection Systems (SD Systems) within Broward County rights-of-way, including any amendments to the revocable license agreements, provided that neither the revocable license agreements nor the amendments impose any additional financial obligation on Broward County, each subject to review and approval for legal sufficiency by the Office of the County Attorney; and authorize the County Administrator, or County Administrator’s written designee, to take all necessary administrative actions to implement same.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE TRAFFIC ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

Motions A and B: The City of Plantation is planning to install School Zone Speed Detection Systems (“SD Systems”) within three school zones on Peters Road and one school zone on West Broward Boulevard.  Construction plans for the installation of the SD Systems were reviewed and approved by the Broward County Traffic Engineering Division (TED) and the Broward County Highway Construction and Engineering Division (HCED).

 

The installation of the SD Systems on Peters Road for the Imagine Charter/Clever Oaks school zone and the South Plantation High school zone are filed under HCED Project Reference Number 241216857 (MOTION A).  The installation of the SD Systems on West Broward Boulevard for the American Heritage school zone and on Peters Road for the Seminole Middle/Tropical Elementary school zone are filed under HCED Project Reference Number 250312657 (MOTION B).

 

The SD Systems will be operated and maintained by the City of Plantation Police Department for the purpose of issuing speeding citations to motorists that exceed the speed limit set by the City ordinance authorizing the placement of a speed detection system on a roadway maintained as a school zone.

 

This item seeks Board approval of two Revocable License Agreements (“Agreements”) between Broward County and the City of Plantation for installation of SD Systems within Broward County right-of-way along Peters Road and West Broward Boulevard in the City of Plantation.

 

The terms of the Agreements begin upon full execution of each of the Agreements and extends in perpetuity or until the County terminates the Agreements. The County can terminate the Agreements with or without cause. If the Agreements are terminated, the City must vacate the licensed areas and return them to their original condition.

 

Motion C: This item, if approved, will facilitate and expedite the approval of future revocable license agreements for SD Systems on County roadways during Fiscal Year 2026. Approval of this item will also constitute direction to the County Attorney’s Office to prepare an amendment to the Broward County Administrative Code to delegate execution authority for future revocable license agreements to ensure expeditious approval of these agreements after September 30, 2026.

 

The Agreements (Exhibits 1 and 2) have been reviewed and approved for legal sufficiency by the Office of the County Attorney.
