Why Action is Necessary

A.                     Broward County Board of County Commissioners (“Commission”) approval is required for agreements with external agencies.

 

B.                     A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

 

What Action Accomplishes

Approval of Motion A would enable the addition of one recurring program to be added to the Agreement with the Broward Behavioral Health Coalition, Inc. (“BBHC”) for transitional recovery housing for individuals experiencing opioid and any co-occurring substance use and/or mental health conditions.

 

Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The Fifth Amendment adds a recurring program for transitional recovery housing for individuals experiencing opioid and any co-occurring substance use and/or mental health conditions. 

 

In April 2026, the Community Partnerships Division (“CPD”) was assigned to manage a portion of the funding received from the Opioid Settlement Funds. The funding supports treatment, prevention, and other strategies to support individuals in treatment and recovery. BBHC is currently a provider funded by CPD to provide mental health jail diversion services, which focus on providing comprehensive care coordination for mental health treatment, substance abuse treatment, and community-based peer support services. 

 

In the United States, an estimated 16.8% of people aged 12 and older-about 48.4 million people-had a substance use disorder in the past year, according to the 2024 National Survey on Drug Use and Health (Mental Health Stats, SAMHSA, 2024). After undergoing detox and a residential treatment program for a substance abuse disorder, many require continued assistance in their efforts to regain economic self-sufficiency and independence. The addition of the transitional recovery housing program to this Agreement will allow BBHC to expand its efforts within the system of care to provide access to well-needed services for those individuals experiencing opioid and any co-occurring substance use and/or mental health conditions.

 

Transitional recovery housing bridges the gap between formal treatment and independent living by allowing those individuals to move gradually from intensive care substance use treatment to community living. Transitional housing provides a safe, semi-controlled environment for individuals in recovery to continue working toward the ultimate goal of becoming independent. Through the incorporation of peer support services and consistent case management, BBHC will assist individuals being served by increasing treatment engagement, reducing hospitalizations, and improving recovery outcomes.

 

The Commission previously approved the funding for the mental health jail diversion services in the amount of $1,500,000. This item requests Commission approval to add $3,000,000 to Option Period 3 of the BBHC Agreement for a recurring transitional housing program for individuals experiencing opioid and any co-occurring substance use and/or mental health conditions, effective October 1, 2026, through September 30, 2027. 

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached as Exhibit 1 and constitutes full disclosure of any existing conflict.
