Why Action is Necessary

MOTION A: Increasing the total budget of a capital project by more than 5% requires approval of the Board of County Commissioners.

 

MOTION B: In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that includes a single bidder.

 

What Action Accomplishes

MOTION A: Transfers $10,000,000 from the Beach Hotspot Project to the Port Everglades IMP Implementation project to fund the revised construction costs.

 

MOTION B: Provides for the furnishing of all labor, materials, equipment, services, and incidentals for the Port Everglades Sand Bypass Project North Jetty Improvements.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the County Commission’s Resilient Community Goal, “Ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

The Office of Economic and Small Business Development determined that no County Business Enterprise participation goal should apply to this solicitation based on the funding source and applicability of state procurement requirements that prohibit the use of statutorily or administratively imposed State or local geographic preferences in the evaluation of bids or proposals (Exhibit 4).

 

This Agreement provides for all labor, materials, equipment, services, and incidentals for the Port Everglades Sand Bypass Project North Jetty Improvements. The project will create infrastructure on the north side of Port Everglades Inlet in Broward County, Florida, to facilitate the collection and storage of beach compatible sand for future transfer to the south side of the inlet. The project includes construction of improvements to the existing north jetty; construction of an extension to the north jetty; and construction of a submerged boulder barrier.

 

This Agreement carries a 100% performance and payment guaranty. The vendor provided a bid guaranty obligating the vendor to provide requisite performance and payment guaranty, upon notice of award.

 

The Agreement includes allowances in the amount of $10,000. Expenditures under the allowances must be approved by the Contract Administrator and will be reimbursed at the vendor’s actual cost without mark-up (Exhibit 3).

 

After advertisement, the Purchasing Division notified potential suppliers; three vendors confirmed intent to bid. On October 23, 2025, the County held a mandatory pre-bid meeting; fourteen vendors attended. After the pre-bid meeting, the County performed additional vendor outreach; only one vendor confirmed intent to bid. Vendors provided different reasons for declining bid participation: scheduling issues, project is not in its scope of work, no capacity to perform work, and only interested in subcontract scope of work.

 

The bid was advertised on October 10, 2025, and opened on December 3, 2025. One bid was received with no declinations (Exhibit 3).

 

Based on the higher bid pricing (versus the project estimate), the County held a vendor meeting on January 6, 2026, with the bidder, Continental Heavy Civil Corp (Continental), the County’s Consultant, and staff from the Purchasing Division and the Public Works and Environmental Services Department to discuss Continental’s base bid pricing. Several reasons were identified for the higher bid pricing (then project estimate).

 

The County may negotiate an adjustment of the scope or requirements of bid, in accordance with Broward County Procurement Code, Section 21.50, Authority to Negotiate Bids. To address some of the reasons identified by Continental, two negotiation meetings were held - January 29, 2026, and February 11, 2026 - to negotiate pricing with Continental. These meetings were attended by the representatives of Continental, the County Attorney’s Office, and staff from the Public Works and Environmental Services Department, and the Purchasing Division.

 

The attendees discussed reworking Notice to Proceed (NTP) 2, issuing NTP3 no later than July 27, 2026, revising Substantial Completion (SC) 1 to require only marine mattress and base layer completion within 120 days, and allowing more time in NTP4 and SC3 for mobilization and completion of boulder barrier.

 

On February 5, 2026, Continental proposed revisions to NTP2 to include access to the North Jetty Extension work area to facilitate preparatory work earlier, revised NTP3 to be issued no later than July 27, 2026, revised NTP4 to be issued no later than SC2 to create a firm issuance window and reduce remobilization risk/cost, revised SC1 to require only marine mattress and base layer completion within 120 days, and revised SC3 duration to extend to 300 days after NTP4 to preserve an appropriate summer 2027 weather window for execution. Continental revised base bid pricing from $33,562,122 to $31,702,322; a savings of $1,859,800. Optional items for Interior Groin were not considered for award.

 

On February 11, 2026, a second negotiation meeting was held with Continental, County’s Consultant, the Purchasing Division and the Public Works and Environmental Services Department staff. County staff asked for additional cost savings from Continental; however, Continental could not identify further cost savings.

 

This item seeks approval to transfer $10,000,000 from the Beach Hotspot project to the Port Everglades IMP Implementation Project for the North Jetty Improvements construction (Exhibit 1).

 

No County vendor performance evaluations have been completed for Continental in the last five years.

 

The Purchasing Division and the Public Works and Environmental Services Department reviewed the bid and updated information submitted by Continental and concur with the recommendation for award (Exhibit 5), to ensure project completion occurs timely and in coordination with other contract work currently being performed.

 

Vendor payments will be based on the actual negotiated amount.

 

The proposed Agreement is Exhibit 1.

Fiscal Impact

Fiscal Impact/Cost Summary

The fixed contract funding source for the North Jetty Improvements project is in the Beach Renourishment Capital Fund in the amount of $31,712,322. The total estimated costs of the overall Port Everglades Sand Bypass Project are approximately $125 million, which includes a Florida Department of Environmental Protection grant (19BO2) to offset the overall costs of the project. Funding for the North Jetty Improvements construction costs will be transferred from the Beach Hotspot project.
