Previous Action Taken

A. On October 6th, 2020 (Item No. 7), the Board of County Commissioners approved Resolution 2020-493 accepting a utility easement executed by LL Hart Development, LLC located at the northeast corner of Griffin Road and US 441 (Commission District 6). The easement was recorded on February 25, 2022, as Instrument #117963342, in the Official Records of Broward County, Florida.

Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

This item involves the release of a 20-foot portion of the County’s utility easement originally adopted under Resolution 2020-493, and the acceptance of a new ten-foot easement over the same area. A land developer abandoned and removed utilities within the existing easement under Utility Connection Permit BCUCP 22-014. The new ten-foot easement is required to allow Broward County to install and maintain the water and sewer mains, along with associated appurtenances serving the public in perpetuity.

 

Motion A approves the partial release of the County’s utility easement located on a portion of Parcel “A”, Griffin Centre, according to the Plat thereof, as recorded in Plat Book 183, Page 197, of the Official Records of Broward County, Florida.

 

Motion B authorizes the County to accept a nonexclusive and perpetual utility easement located on a portion of Parcel “A”, “Griffin Centre”, according to the Plat thereof, as recorded in Plat Book 183, Page 197, of the Official Records of Broward County, Florida.

 

The Resolution and utility easement have been reviewed and approved as to form by the County Attorney’s Office.
