MOTION TO ENACT Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO SPECIAL DISTRICTS; REPEALING ARTICLES III AND IV OF CHAPTER 16 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”) RELATING TO THE NORTH AND SOUTH BROWARD HOSPITAL DISTRICTS; REPEALING VARIOUS SECTIONS OF CHAPTER 30 OF THE CODE RELATING TO THE CENTRAL BROWARD DRAINAGE DISTRICT, THE CORAL SPRINGS IMPROVEMENT DISTRICT, THE PLANTATION ACRES IMPROVEMENT DISTRICT, THE NORTH LAUDERDALE WATER CONTROL DISTRICT, THE NORTH SPRINGS IMPROVEMENT DISTRICT, AND THE OLD PLANTATION WATER CONTROL DISTRICT; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Commission”) at its meeting of January 22, 2026.
What Action Accomplishes
Allows for the Commission’s consideration of the proposed Ordinance.

Summary Explanation/Background
After the Broward County Charter was adopted in 1974, the Code incorporated and restated numerous preexisting special acts of the Florida Legislature. Since then, the Florida Legislature has repealed or amended certain of those special acts pertaining to special districts in the County. The Code provisions are therefore outdated and should be repealed.
The County Attorney’s Office has conferred with counsel for each of the affected special districts, and none expressed any objection to repealing the applicable Code provisions.
