Why Action is Necessary

A. Board of County Commissioners approval is required to increase the change order allowance above 10% of the original contract amount, in accordance with Broward County Procurement Code, Section 21.56.

 

B. Transferring funds from reserve to increase the budget of a capital project requires approval of the Board of County Commissioners.

 

What Action Accomplishes

A. Increases change order allowance from 15% to 23% of the original construction contract amount.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

The Public Safety Building Fire Alarm Public Address and System Installation project is an upgrade and replacement of the existing fire alarm and public address system in the Ron Cochran Public Safety Complex, located at 2601 W. Broward Boulevard, Fort Lauderdale, FL 33312

 

The Office of Economic and Small Business Development established a cumulative County Business Enterprise (CBE) goal of 25% for this agreement. The vendor has committed to 25% CBE participation. Florida Palm Construction, Inc., has been paid $1,890,498 with $1,890,498 paid to CBE firms, yielding 100% participation to date.

 

On June 1st, 2021(Item No. 40), the Broward County Board of County Commissioners executed Bid/Contract No. PNC2121515C1 with Florida Palm Construction, Inc. (“the Contractor”) for the Public Safety Building Fire Alarm Public Address and System Installation project in the amount of $1,917,059.  The Administrative Change Order allowance was increased from $95,853 or 5% to $191,706 or 10% of the original contract amount, to address unforeseen site conditions.

 

On July 13th, 2023, the County Administrator approved an additional 5% allowance increase from $191,706 or 10% to $287,559 or 15% of the original contract amount of $1,917,059 to address unforeseen site conditions.  Unforeseen conditions included changes to interior spaces by the Broward Sheriff’s Office which required reconfiguration of the fire alarm system design and installation in those areas.

 

Motion A allows for an allowance increase from $287,559 or 15% to $440,924 or 23% of the original contract amount of $1,917,059 to address redesign and reconfiguration of the fire alarm system by adding, relocating or removing approximately 156 separate fire alarm devices.  This increase results from updates of the facility as-built drawings incorporating missed devices by the consultant, and to reflect additional changes due to ongoing interior renovation work being performed by the Broward Sheriff’s Office.  This increased change order allowance will enable the issuance of a change order to the Contractor to complete the work to replace the existing fire alarm system.

 

Motion B allows for a one time increase in the project budget to fund installation of additional fire alarm scope of work by the Contractor.  The original construction cost was based on an approved fire alarm design.  Interior renovation work performed by the Broward Sheriff’s Office before completion of the fire alarm installation required changes to the completed fire alarm system design.  This additional cost was not anticipated at the start of the project.
