Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

This item supports the Board’s Connected Community Goal, “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 30% for this contract. HC&E Group, Inc. (HC&E) committed to the 30% CBE participation goal; Primus Construction Services, Inc. (Primus Construction) committed to a 60% CBE participation goal. Both participation goals been reviewed and approved by OESBD (Exhibit 2).

The contracts provide for installation of ADA complaint transit improvements, such as installing transit shelter foundations, bench pads, shelters, amenities, and construction of required foundations, sidewalks, bus stop landing areas, curb cuts, etc. at bus stops throughout Broward County.

Each contract identifies allowances in the total amount of $185,000 for the initial term. Expenditures under the allowances must be approved by the Contract Administrator and will be reimbursed at the vendor’s actual cost without mark-up.

The Director of Purchasing determined the apparent low bidder, Emerald Construction Corporation d.b.a. Neucor Construction, to be non-responsible based on non-compliance with the required CBE goal participation.

The Transportation Department has reviewed the bids submitted by HC&E and Primus Construction and concurs with the recommendations for awards (Exhibit 3).

Four County vendor performance evaluations were completed for Primus Construction; the vendor has an overall performance rating of 4.07 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.

No County vendor performance evaluations have been completed for HC&E.

The initial bid submitted by Primus Construction was $1,782,875; the vendor offered a voluntary price reduction of $31,000, which reduced the total bid amount to $1,751,875. Broward County Procurement Code Section 21.41(b), Procedures for ITBs, allows for acceptance of a voluntary reduction in price after bid opening, if such reduction does not result in the modification or deletion of any condition of the solicitation.

The Purchasing Division reviewed the prices submitted by HC&E and Primus Construction and has determined that the prices submitted are fair and reasonable in comparison to a previous Broward County contract for these same services (Exhibit 4).

Incumbent: FG Construction, LLC, Bid No. TRN2126458B1, Transit Bus Stop Infrastructure Improvements. Contract Term: September 25, 2023 through September 24, 2024. Expenditures to date: $520,644.

The bid was advertised on September 21, 2024 and opened on December 30, 2024; seven bids were received with three declinations (Exhibit 1).

The Recommendation for Award was posted on the Purchasing Division website from April 7 - 11, 2025.

HC&E’s bid validity expired on April 29, 2025, and HC&E has agreed to extend it through June 30, 2025.

Primus Construction’s bid validity expired on April 29, 2025, and Primus Construction has agreed to extend it through June 30, 2025.

The initial contract period, for both contracts, begins on date of award and will terminate three years after, unless extended.
