A. MOTION TO ADOPT Resolution providing funding for certain services, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, AUTHORIZING APPROPRIATION AND DISBURSEMENT OF FUNDS IN THE AGGREGATE AMOUNT OF $3,354,544 TO CONTRIBUTE TO LOCAL MATCH FUNDING FOR SPECIFIED SERVICE PROVIDERS FOR THE STATE OF FLORIDA FISCAL YEAR 2025-2026; AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE AGREEMENTS WITH SPECIFIED SERVICE PROVIDERS AND TO TAKE ALL NECESSARY ADMINISTRATIVE AND BUDGETARY ACTIONS TO IMPLEMENT THE AGREEMENTS; AND PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
B. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item:

Why Action is Necessary
A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for agreements with external agencies.
B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.
What Action Accomplishes
Adoption of Motion A authorizes distribution of local match funding from Broward County to specified service providers as required by Section 394.76(9)(a), Florida Statutes. This action further authorizes the County Administrator to execute the individual agreements with the service providers.
Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” Local match funding supports the provision of an array of mental health and substance use disorder treatment services in the community.
In accordance with Section 394.76(9)(a), Florida Statutes, Broward County must provide local match funds to community mental health and substance use disorder treatment service providers based on the Fiscal Year 2025-2026 funding allocated by the State of Florida Department of Children and Families, Circuit 17. The statute also requires these funds be provided at a 75-to-25 state-to-local ratio. Section 394.67(14), Florida Statutes, defines local match funding as monies received from governing bodies, including city commissions, county commissions, district school boards, special tax districts, private hospital funds, private gifts (both individual and corporate), bequests, and funds received from community drives or any other sources. Broward Behavioral Health Coalition, Inc. (“BBHC”) is responsible for the local management and oversight of the array of services, including tracking and monitoring outcome achievement for its service providers.
The local match application process is conducted each Fiscal Year; thus, the agreement period is aligned with the state Fiscal Year, from July 1, 2025, to June 30, 2026. Fourteen service providers qualified for state Fiscal Year 2025-2026 local match funding in the amount of $3,354,544 (Exhibit 1, Attachment A). This amount is available in the County’s Fiscal Year 2025-2026 non-departmental budget for appropriation and disbursement.
Approval of this item also authorizes the County Administrator to execute adjustments to the maximum funding provided in each agreement by up to 10% during the term of the agreement if the County Administrator determines such an adjustment is necessary due to a change in Broward County’s local match funding obligation for that agreement and subject to review and approval for legal sufficiency by the County Attorney’s Office. Amendments greater than 10% require Commission approval and will be reviewed for legal sufficiency by the County Attorney’s Office before execution. Broward County will utilize the previously approved local match funding standard form agreement for agreements with the service providers.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer...shall have or hold any employment or contractual relationship with any business entity...which is...doing business with an agency of which he or she is an officer or employee.” In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 2 and constitute full disclosure of any existing conflicts.

The local match amount of $4,214,440 was adopted in the Fiscal Year 2025-2026 non-departmental budget. This item requests appropriation and disbursement of $3,354,544 from the budgeted local match amount, leaving a surplus of $859,896. Commission approval will also allow adjustments to the maximum funding provided in each agreement by up to 10% of the total local match allocation, for a maximum additional $335,454 and a potential aggregate amount of $3,689,998.
