Direction by the Board of County Commissioners (“Commission”) is required for the County Attorney’s Office to draft an Ordinance amending the Broward County Code of Ordinances.

Summary Explanation/Background

Construction and demolition (“C&D”) debris constitutes a significant component of Broward County’s solid waste stream and represents one of the County’s greatest opportunities to increase recycling and reduce disposal. Broward County’s 2023 Waste Characterization Study (Exhibit 1) found that nearly three-quarters (73.5%) of the County’s disposed C&D and bulky waste stream consists of materials that are potentially divertible, including concrete, brick, asphalt roofing, wood, and textiles. An additional 2.2% of the stream is currently recyclable and 4.2% is compostable, meaning approximately 80% of the C&D/bulky waste stream could potentially be diverted from disposal through recycling, reuse, composting, or other recovery programs. The study identified asphalt roofing, engineered wood, treated wood, brick, and concrete as the largest potentially recoverable material categories and specifically recommended that Broward County develop programs to further divert C&D materials and work with contractors to separate recoverable materials for recycling and reuse.

 

Consistent with those recommendations, this item seeks Commission direction to the County Attorney’s Office to draft an Ordinance amending Chapter 14, Article V of the Broward County Code of Ordinances to establish a construction and demolition debris recycling program, to the extent permissible under state law. The proposed Ordinance would generally apply to construction and demolition projects requiring applicable County building or demolition permits and would establish requirements for the preparation and submission of construction and demolition materials management plans, diversion reporting, recordkeeping, and other enforcement mechanisms reasonably necessary to implement the program and verify compliance.

 

This item directs the County Attorney’s Office to prepare a proposed Ordinance incorporating these concepts for future Commission consideration.
