Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION
This item supports the Board’s values of “cultivating community culture, arts, recreation and life-long learning” and its associated goal to market and deliver world-class recreational opportunities; and of “consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work and visit” by building into every process and service effective checks and balances that do not cause inefficiency, but rather ensure consistency, continuity, and quality. The aquatic risk management consultant services provided by Jeff Ellis and Associates, Inc. (Jeff Ellis) allow the Parks and Recreation Division (Parks) to provide patrons at the four County aquatic facilities high quality services.
On March 6, 2019, Broward County, through its Purchasing Director, entered into an agreement with Jeff Ellis for comprehensive aquatic risk management services at the County’s aquatic facilities. The initial term of the agreement was for three years, with the option to renew the agreement for up to two, one-year terms, with the overall contract term ending on March 4, 2024.
On March 1, 2024, the Director of Purchasing executed a 60-day extension to the agreement while Parks finalized an Informal Request for Proposal (IRFP), Solicitation GEN2127746Q1. On May 6, 2024, the Director of Purchasing executed a four-month extension to allow continuity of services through September 4, 2024. Solicitation GEN2127746Q1 resulted in only one proposal, which was submitted by the incumbent vendor. As such, Parks recommended entering into negotiations with Jeff Ellis for a formal First Amendment. As all renewal options had been exhausted, the agreement expired on September 4, 2024, before negotiations could be finalized.
Therefore, Parks is requesting to reinstate the agreement, retroactive to January 1, 2025. All terms and conditions will remain the same except the modification of the indemnification language and prices increases from the original Agreement. The First Amendment will allow the continuance of the aquatic risk management services before the start of the Division’s upcoming aquatic season.
The First Amendment has been reviewed and approved for legal sufficiency by the Office of the County Attorney.

The annual not-to-exceed amount paid by County to Contractor is $50,000 which is budgeted in the Division’s general fund budget.
