Why Action is Necessary

Pursuant to Section 163.3184, Florida Statutes, as amended, the Broward County Board of County Commissioners, serving as the local governing body, shall transmit to designated State agencies proposed amendments to the Broward County Comprehensive Plan for review.

 

What Action Accomplishes

This action adopts a Resolution to transmit to designated State review agencies Broward County Land Use Plan text amendment PCT 26-3, pursuant to Section 163.3184, Florida Statutes, as amended.

January 22, 2026 - The County Commission set a transmittal Public Hearing for March 3, 2026.

 

Summary Explanation/Background

The Planning Council, as the Local Planning Agency (LPA) responsible for the Broward County Land Use Plan, considered the following proposed text amendment, PCT 26-3, at its December 4, 2025, public hearing and recommended approval, including not requiring a second Planning Council public hearing (Vote of the Planning Council; 10-1; Yes: Abramson, Fernandez, Fisher, Geller, Greenberg, Hardin, Levy, Newbold, Rosenof and DiGiorgio. No: Ryan):

 

AMENDMENT PCT 26-3

Amendment to the Broward County Land Use Plan text to delete Policies 2.36.1 and 2.36.2 regarding land use policy and public infrastructure and services decisions

 

The full amendment report and associated attachments are provided in Exhibit 2 of this public hearing item.

 

Exhibit 3 is substitute language submitted by the Broward County Attorney’s Office based on the Commission’s discussion at the January 22, 2026, setting of the public hearing. If the County Commission votes to transmit the substitute language or other alternate language to the State of Florida review agencies, the proposed text amendment will return to the Broward County Planning Council for a second public hearing and recommendation prior to being scheduled for consideration of adoption by the County Commission.
