Pursuant to Section 163.01, Florida Statutes, action is required by the Broward County Board of County Commissioners to approve Interlocal agreements between Broward County, municipal governments, and independent districts.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL PLANNING AND COMMUNITY RESILIENCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the County Commission’s Value: Encouraging investments in renewable energy, sustainable practices and environmental protection; and the Goals: Seek funding for, implement policies and pursue projects promoting, the use of alternative energies and sustainable practices; and increase water quality protection efforts and lead creative approaches to water storage and aquifer recharge, as well as diversification of water supplies, regionally.
Action on this item approves Interlocal Agreements between Broward County and 17 municipalities and water utility partners in the continued operation of the NatureScape Irrigation Service (NIS). Under these agreements, Broward County’s Environmental Planning and Community Resilience Division is provided reimbursement for NIS evaluations and administrative services associated with delivery of this regional program. This is the third five-year renewal supporting NIS operations and demonstrates cost-effective collaborations in furtherance of regional water quality and water conservation goals.
On December 6, 2005, Broward County and 21 municipal and water utility partners entered into an interlocal agreement providing for an initial five-year partnership and cost-share funding to launch and operate an urban mobile irrigation lab, aka NatureScape Irrigation Service (NIS). The NIS partnership was renewed on April 13, 2010, for a second five-year term, with the participation of 18 municipal and water utility partners, and in spring 2015 (March 17, April 14, and May 5, 2015, Commission meetings) for a third five-year term, with the participation of 19 municipal and water utility partners.
The Broward NIS, modeled after the State’s Mobile Irrigation Lab program, is designed to focus on large municipal and professionally-managed properties where the potential for achieving significant water savings is greatest. Services consist of site assessments to measure current water consumption, evaluate current irrigation efficiencies, and provide recommendations for reducing water usage through more efficient irrigation system design and operation. The NIS also provides recommendations for landscape improvements in accordance with NatureScape Broward principles. Water savings achieved to date are nearly 1.7 billion gallons, and NIS services have achieved an average 21% reduction in water usage per site evaluated.
Performance will continue to be measured based on the number of site evaluations completed in a year and water savings achieved, a reporting procedure that is consistent with State recommendations for goal-based water conservation initiatives and supportive of consumptive use permit requirements with the South Florida Water Management District.
In 2019, the NIS pilot-tested a Residential Irrigation Rebate Program, distributing 60 rebates to residents for irrigation system upgrades and providing education and guidance on efficient landscape irrigation practices. The applications for rebates under the pilot program well-exceeded the pilot program capacity, revealing a significant opportunity and need for a more sustained residential irrigation program component from the public. As such, the County is offering the Residential Irrigation Program as an optional add-on to the NIS, with twelve communities participating.
Agreements covered in Motions A through E have been provided final legal review by the Office of the County Attorney and approved as to form. The agreements covered in Motions F through Q are pending partner approvals and will be reviewed and approved as to form by the Office of the County Attorney prior to execution by the County Administrator.

The total funding to be provided to the County based on the Interlocal Agreements in Exhibits 2A-2E and represented by Exhibit 3F-3Q is $1,096,011, over a period of five years, with in-kind services to be provided by Broward County. Collected revenues will be deposited into the Water Resources NatureScape Irrigation Services contract fund budget.
