A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners (“Board”) at its meeting of October 22, 2024.

Summary Explanation/Background

The Broward County Parks and Recreation Division (“Division”) charges various fees for the programs and services of Broward County’s parks system (“Fee Schedule”). The Division updates its Fee Schedule annually, based upon changes in services and an annual determination of the fees that are reasonable and necessary.

 

Provisions regarding the setting of the Division’s fees are currently contained in two separate chapters of the Broward County Administrative Code (“Administrative Code”). The proposed Resolution consolidates these provisions into a single chapter.

 

Currently, the Administrative Code does not permit the Division’s Director (“Director”) to make minor changes to the Fee Schedule outside of the annual update process. The proposed Resolution authorizes the Director to approve minor fee modifications that do not exceed the lesser of 25% of the fee or $100.

 

Additionally, the proposed Resolution authorizes the Director to discount or waive parks fees (1) for Division employees up to a total amount of $5,000 annually; (2) for County employees up to 50% of the applicable fee (currently limited to $2,500 annually) as part of a promotional program approved by the Director; and (3) for the public up to a total amount of $10,000 annually (currently limited to $1,000 annually) as part of an approved marketing campaign.

 

Finally, the proposed Resolution would expand the ability of the Division to impose fees for dishonored or disputed payments to include all types of payment cards and to allow the Division to require repayment of such amounts (including the fee for the dishonored payment) by money order, a certified bank check, or cash.
