Why Action is Necessary

Board action to accept a conservation easement is authorized by Sections 125.01(3) and 704.06(3), Florida Statutes, and necessary to fulfill the requirements of Environmental Resource License (ERL) No. DF00-1007, issued pursuant to Chapter 27 of the Broward County Code of Ordinances.

 

What Action Accomplishes

The action provides for the perpetual maintenance and conservation of the mitigation site by the grantor.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

On April 25, 2000, the Resilient Environment Department (RED) issued ERL No. DF00-1007 (see pages 16 through 31 of Exhibit 1), to Roscioli Yachting Center, Inc. The ERL authorized impacts to 0.04 acre of mangrove wetlands and required conveying a Deed of Conservation Easement to the County (Exhibit 1) over the area as shown in pages 11 through 14 of Exhibit 1 to ensure it will remain in perpetuity and be maintained by the grantor.

 

The Deed of Conservation Easement has been reviewed and approved as to form by the Office of the County Attorney.
