Summary Explanation/Background

Broward County regulates the operation of child care facilities and family child care homes in Broward County, as permitted by Florida law. The applicable local regulations, codified in Chapter 7 and Article XV of Chapter 20, respectively, of the Broward County Code of Ordinances (collectively, the “Child Care Ordinances”), set forth licensing standards that are equal to or more stringent than the state standards.

As the local licensing agency, the County’s Child Care Licensing and Enforcement Section (“CCLE”) enforces not only the Child Care Ordinances but also certain State statutes and rules promulgated by the Florida Department of Children and Families (“DCF”).

Due to substantive revisions by DCF in the state minimum standards, CCLE has revised the County’s Child Care Ordinances to ensure they meet or exceed state minimum standards. The proposed Ordinance is recommended by CCLE to update the Child Care Ordinances to align with the revised DCF regulations, and to ensure that, where appropriate for Broward County, higher standards remain included in the Child Care Ordinances. A memorandum from the County Attorney’s Office outlining the major substantive changes is attached as Exhibit 2.
