What Action Accomplishes

The Subordination Agreement allows the subordination of Broward County’s interest in the existing easement area to FDOT which is required by FDOT for public transportation purposes.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/ REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

Broward County (“County”) is the holder of a Pedestrian Easement (recorded in Official Records Book 20781, Page 361) (“Easement”) on certain portions of real property owned by South Broward Hospital District (“Owner”) located at 12235 Pines Boulevard, Pembroke Pines, Florida 33026 (“Property”). The Property is located adjacent to Flamingo Road and Pines Boulevard, which are functionally classified as State jurisdictional roads. In connection with the construction of the Memorial Hospital West Cancer Institute, Owner is required to dedicate a portion of the public sidewalk to FDOT, which is located within the County’s Pedestrian Easement.  FDOT plans to add a ramp to make ADA accommodations to the dedicated sidewalk area for public transportation purposes.

 

Per FDOT’s Land Title Procedures, FDOT is required to receive dedicated lands that are marketable, and the title is free of any incumbrances requiring all entities with an interest in the proposed dedicated land area execute a Subordination Agreement subordinating their interests to FDOT. The Subordination Agreement has been reviewed by the Broward County Attorney’s Office, Broward County Traffic Engineering Division, and Broward County Highway Construction and Engineering Division, and there are no objections to subordinating the County’s interests.

 

All documents have been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
