Why Action is Necessary

Board action to accept a conservation easement is authorized by Sections 125.01(3) and 704.06(3), Florida Statues, and necessary to fulfill the requirements of Environmental Resource License (“ERL”) No. DF05-1113, issued pursuant to Chapter 27 of the Broward County Code of Ordinances.

 

What Action Accomplishes

The action provides for the perpetual maintenance and conservation of the mitigation area by the grantor.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

On November 30, 2006, the Public Works and Environmental Services Department issued ERL No. DF05-1113 (see pages 27 through 43 of Exhibit 1), to Parkland Vista, Ltd., and GMAC Model Home Finance, LLC. ERL No. DF05-1113 required 1.822 acres of multi-habitat wetland mitigation areas with native wetland vegetation to establish a viable wetland.  ERL No. DF05-1113 also required the conveyance of a Deed of Conservation Easement to the County over the wetland mitigation areas to ensure they will remain in perpetuity and be maintained by the grantor.

 

The parcels over which the mitigation areas were to be established were dedicated to North Springs Improvement District by plat (ORB Plat Book 177, Page 15) on July 16, 2007. The Deed of Conservation Easement to the County (Exhibit 1) being granted by North Springs Improvement District includes four multi-habitat wetland mitigation areas with native wetland vegetation that add up to a total area of 1.833 acres, as shown in pages 10 through 26 of Exhibit 1.

 

The Deed of Conservation Easement was reviewed and approved as to form by the Office of the County Attorney.
