Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a rejection of apparent low bidder.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) designated this project as a reserve opportunity for certified County Business Enterprise firms. Due to the lack of subcontracting opportunities, OESBD recommended the 25% CBE goal waived if a non-CBE bidder is considered for award; the Board was notified of the waiver. All-Brand Supplies Distributor, Inc. (ABS Distributor) is not a certified CBE (Exhibit 2).
This contract provides concession food items for resale at various Broward County Parks and Recreation locations.
The Director of Purchasing determined that the apparent low bidder, Nini’s Vending and Snacks, LLC (Nini’s Vending), non-responsive to the Basis of Award requirements. Bidders were required to bid on all line items; Nini’s Vending submitted bids for 15 of the 28 line items.
Line items 16 and 17 were not recommended for award; the County determined that there were inconsistencies identified between the specifications and the bid table descriptions.
The Parks and Recreation Division has reviewed the bid submitted by ABS Distributor and concurs with the recommendation for award (Exhibit 3).
No County vendor performance evaluations have been completed for ABS Distributor.
The Purchasing Division reviewed the prices submitted by the low responsive, responsible bidder, ABS Distributor, and determined the prices submitted are fair and reasonable (Exhibit 4).
Incumbent: King’s Cup, Inc., Contract Number and Title: OPN2124277B1, Concession Food Items, Contract Term: June 7, 2022 through June 6, 2023, First Renewal: June 6, 2023 through June 6, 2024, Second Renewal: June 6, 2024, through December 4, 2025. Expenditures to date: $1,012,377.
The bid was advertised on August 14, 2025, and opened on September 26, 2025. Four bids were received, with one declination.
The Recommendation for Award was posted on the Purchasing Division website. There was no protest filed against this procurement.
ABS Distributor’s bid validity expired on January 24, 2026; ABS Distributor has agreed to extend it through April 24, 2026.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The awarded contract consists of the County’s solicitation and the vendor’s response.
The initial contract period begins on date of award.
