Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL ON THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of at least 25% for County contracts, except in those instances where contracts are exempt. A goal of 25% is deemed to be too high for the negotiated CBE commitments and the specialized work expected to be completed by LEO A DALY and its team of specialty consultants. OESBD established a 21% CBE goal for this agreement (Exhibit 2).
The Amended and Restated Agreement provides comprehensive architectural and engineering services for the design, construction administration, and warranty services of a new Forensic Science Center located at 2000 W. Commercial Blvd., Fort Lauderdale, FL 33309.
The new combined facility is anticipated to be organized as a multi-story building or series of buildings, including a parking garage. The new building(s) will be designed as “essential facilities” in accordance with the Florida Building Code and will be designed to maintain operations immediately following a disaster or weather-related event and to meet the highest standards for resiliency and sustainability. The project will seek Leadership in Energy and Environmental Design (LEED) certification.
On January 29, 2019 (Item No. 38), the Board of County Commissioners approved an Agreement for Consultant Services between Broward County and LAD to provide phased planning services to produce facilities programming and site utilization analysis layouts for predesign phase activities in the lump sum amount of $652,361, including reimbursables in the maximum not-to-exceed amount of $5,000, and optional services in the maximum not-to-exceed amount of $50,000, for a site located at 1625 NW 23rd Avenue, Fort Lauderdale, FL 33311.
On December 8, 2020 (Item No.3), the Board of County Commissioners approved a First Amendment to the Agreement for full design, construction, and warranty services in the lump sum amount of $14,303,522, including optional services in the maximum not-to-exceed amount of $1,650,000 and reimbursables in the maximum not-to-exceed amount of $245,000.
On July 7, 2021 (Item No. 6), the Board of County Commissioners approved a Second Amendment to the Agreement to adjust the calendar days for the 50% Construction Document phase and amended section 4.3 of the Agreement to allow the Contract Administrator to adjust the time periods in the project schedule.
LAD was paid the total amount of $5,535,992, for completed programming, schematic design, and design development services relating to the former site located at 1625 NW 23rd Avenue, Fort Lauderdale, FL 33311.
On January 11, 2024, the Board of County Commissioners approved the purchase of a new site, approximately nine acres in size, located at 2000 W. Commercial Blvd. in Fort Lauderdale for the new Forensic Science Center to be built. This Amended and Restated Agreement establishes the terms and conditions upon which LAD will provide professional services at this new location.
Staff held five negotiation meetings with LAD representatives on December 11th, 2024, December 19th, 2024, January 13th, 2025, February 13th, 2025, and February 27th, 2025.
The Amended and Restated Agreement has been reviewed and approved as to form by the Office of the County Attorney.
