Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT, THE HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION, AND THE MOBILITY ADVANCEMENT PROGRAM RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The City of Wilton Manors (City) included the NE 26th Street Roadway Improvements Project (“Project”) in its proposed municipal capital projects under the original 2018 transportation surtax municipal program of projects. In 2019, the City submitted the Project’s scope and details to the Broward Metropolitan Planning Organization (“MPO”) under its Surtax Services Agreement for review, ranking, and a possible funding recommendation. Because WILT-003 is a County-owned road, the County’s Public Works and Environmental Services Department, and Highway Construction and Engineering Division provided written consent for the City to take the lead on the project as tentatively scoped. In February 2020, the MPO surtax services team recommended funding the design phase of the Project as part of Cycle 1. The Project was designed by Kimley-Horn and Associates, Inc. with surtax funding, and there remains a total of $69,705 in surtax funding under that Agreement for post-design services. In April 2025, the City began submitting documentation necessary to go under a construction agreement in a maximum-not-to-exceed amount of $1,760,000.

 

During the construction-phase agreement negotiations, the City and County discussed potential shortfalls in the construction funding award level and possible approaches, which were also shared with County Administration. With County approval, the City published the solicitation to gauge prices and gain a better understanding of the expected funding delta. On September 4, 2025, the City advised that the construction bids had been opened and the apparent low bidder (at $1,500,000) was being evaluated. The City submitted the proposals to the Office of Economic and Small Business Development (“OESBD”) for their County Business Enterprise (“CBE”) compliance review. OESBD provided the review results to the City on September 22, 2025, confirming the bidder selected met the assigned CBE goal and was compliant with the program requirements. The City selected the bidder but expressed written concerns to the surtax legal team and contract administrator over delivering the construction project on a County-owned road. On November 18, 2025, the County’s Highway Construction and Engineering Division communicated willingness to deliver the construction of the Project to the City. The City was still not, and has never been, under a construction project funding agreement for WILT-003.

 

With the cooperation and approval of the City and the awarded contractor and design firm, pursuant to Section 5.4 of the Third Amendment to and Restatement of the Transportation System Surtax Interlocal Agreement, Board approval is requested for the County to exercise the option to deliver the Project . If this item is approved, the County will coordinate with the City, the design firm, and construction contractor to execute all necessary documents required to: (a) have the design firm perform post-design services as provided under its contract with the City associated with the Project; (b) contract with the City’s awarded contractor to perform the construction of the Project; and (c) assign any City agreements to the County that are necessary in connection with the County’s delivery of the post-design and construction phases of the Project.

 

All such agreements will be subject to review and approval for legal sufficiency by the Office of the County Attorney.

 

The scope of the NE 26th Street Project from east of Dixie Highway to west of Federal Highway will include milling and resurfacing, sidewalk widening, median islands, midblock pedestrian crossing including rapid flashing beacons, pavement markings, ADA improvements, and landscaping.

 

The project will be implemented with no change in the number of vehicle travel lanes.

 

All funding for the delivery of the Project will come from the transportation surtax funding awarded to the City for the remaining post-design services and construction phase of the Project.
