Why Action is Necessary

A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners (“Commission”) at its meeting of September 10, 2026.

Allows for the Commission’s consideration of the Resolution Amending the Broward County Administrative Code (“Administrative Code”).

Summary Explanation/Background

During the 2024 Legislative Session, the Florida Legislature enacted Chapter 2024-80, Laws of Florida, which amended Section 218.077, Florida Statutes, effective September 30, 2026. As amended, Section 218.077 prohibits political subdivisions from imposing certain wage and employment benefit requirements through procurement and contracting procedures for contracts entered into on or after September 30, 2026. On August 20, 2026, the Commission enacted amendments to the County’s Domestic Partnership Ordinance, Prevailing Wage Ordinance, and Living Wage Ordinance to comply with Section 218.077, Florida Statutes, as amended.

This Resolution makes corresponding amendments to the Broward County Procurement Code (“Procurement Code”) by removing references to the Domestic Partnership Ordinance, including its incorporation into applicable solicitations, and by also removing domestic partner benefits as a tie-breaker criterion in competitive solicitations.

The Resolution also eliminates the procurement objection process, which permits vendors, prior to filing a protest, to object to the proposed rankings based on information that was not presented or submitted to the Evaluation Committee when it made its ranking. The Purchasing Division retained an outside consultant to make recommendations for improving the efficiency of the competitive solicitation process, and the consultant recommended eliminating the objection process. The proposed Resolution also makes conforming amendments to the remainder of the Procurement Code to eliminate references to the objection process and makes other minor amendments.
