Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, the Board of County Commissioners’ approval is required for threshold increases above the $500,000 award authority of the Director of Purchasing.
What Action Accomplishes
Provides additional funding threshold to ensure continuity of service and timely responses for household hazardous waste collection and disposal at the three residential drop-off centers and remote events throughout the County for the remainder of the potential five-year contract through January 14, 2029.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
On January 15, 2024, the Director of Purchasing, through the clean bid process, awarded Contract No. OPN2127382B1_1 for household hazardous waste collection and disposal to Clean Harbors Environmental Services, Inc. (the “Contract” - Exhibits 1 and 2), with an initial three-year term and including two optional one-year renewals for a potential five-year maximum award amount of $1,287,413.
On May 27, 2025, the Director of Purchasing approved a threshold increase to the Contract in the amount of $301,507 increasing the potential five-year maximum contract amount to $1,588,920.
On September 19, 2025, the Director of Purchasing approved a threshold increase to the Contract in the amount of $198,493 increasing the potential five-year maximum contract amount to $1,787,413.
It has been determined that the original Contract threshold of $772,448 was inadequate, as that amount represented only the forecasted expenditures for the first year of the Contract. The threshold amount for the initial three-year term should have been $2,344,235. As the County approaches the end of the second year of the Contract, with expenditures of $1,273,953, a threshold increase of $2,421,152 is needed to meet services demands for household hazardous waste collection and disposal at the three residential drop-off centers and remote events throughout the County for the remainder of the potential five-year Contract through January 14, 2029.
