AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY LOCAL PROVIDER PARTICIPATION FUND ORDINANCE; AMENDING ARTICLE V OF CHAPTER 16 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); UPDATING THE ASSESSMENT STRUCTURE TO ADDRESS PROPOSED CENTERS FOR MEDICARE & MEDICAID SERVICES WAIVER-RELATED HOSPITAL EXEMPTIONS; AUTHORIZING THE USE OF ASSESSMENT PROCEEDS FOR ADDITIONAL MEDICAID SUPPLEMENTAL PAYMENT PROGRAMS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
The Broward County Local Provider Participation Fund Ordinance (“LPPF Ordinance”), as set forth in Article V of Chapter 16 of the Broward County Code of Ordinances, authorizes the Board to impose a uniform non-ad valorem special assessment upon local private hospital properties in Broward County (“Assessment”) pursuant to the Medicaid Managed Care hospital directed payment program administered by the State of Florida. The Assessment funds a portion of the nonfederal share of Medicaid supplemental payment programs administered by the State. In 2024, the Board amended the LPPF Ordinance to authorize the use of Assessment proceeds for supplemental payments under the Low Income Pool Program.
The proposed Ordinance further amends the LPPF Ordinance to address recent developments relating to the State’s hospital assessment structure and Medicaid supplemental payment programs. Specifically, the proposed Ordinance addresses potential hospital exemptions associated with Centers for Medicare & Medicaid Services (“CMS”) waiver requests and authorizes the use of Assessment proceeds for additional Medicaid supplemental payment programs, including CMS-authorized managed care quality incentive programs. The proposed Ordinance also revises certain definitions and administrative provisions to provide additional flexibility in the implementation and administration of the Assessment program.
The Assessment would continue to be imposed only after the Board adopts a resolution each fiscal year following receipt of a petition signed by at least seventy-five percent (75%) of the affected local private hospitals. Once imposed, hospitals subject to the Assessment would remain eligible to receive financial benefits associated with the applicable Medicaid supplemental payment programs authorized under the LPPF Ordinance.
