B. MOTION TO APPROVE waiver of conflict under Section 112.313(7)(a), Florida Statutes for Tony Fonseca, Shane Wilkinson, Michael Stamm, and Rob Gooljar who hold employment or contractual relationships with entities that receive funds from Broward County.

Why Action is Necessary
A. The Board must approve appointments and reappointments to advisory boards.
B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Board in accordance with Section 112.313(12), Florida Statutes.
What Action Accomplishes
A. Appoints Tony Fonseca, Shane Wilkinson, Michael Stamm, and Rob Gooljar to the North Perry Airport Community Advisory Committee.
B. Waives the existence of any conflict arising under Section 112.313(7)(a), as authorized under applicable law.

Summary Explanation/Background
The following nominations have been received by the Office of Intergovernmental Affairs for appointment to the North Perry Airport Community Advisory Committee:
1. Tony Fonseca in the category of “one member from the North Perry Airport Community Association, nominated by the North Perry Airport Community Association.”
2. Shane Wilkinson in the category of “one member from the Airport Traffic Control Tower, nominated by the Airport Traffic Control Tower Manager.”
3. Michael Stamm in the category of “one member from the City of Pembroke Pines Planning & Economic Development Department, nominated by the City of Pembroke Pines.”
4. Rob Gooljar in the category of “one member from the City of Hollywood Division of Planning and Urban Design, nominated by the City of Hollywood.”
The letters nominating Tony Fonseca, Shane Wilkinson, Michael Stamm, and Rob Gooljar are attached as Exhibit 1. Additional documentation forthcoming.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer shall have or hold any employment or contractual relationship with any business entity which is doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Board approval is required to waive any conflict arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires a two-thirds vote of the County Commission after full disclosure of the conflicting relationship. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached hereto as Exhibit No. 2 and constitutes full disclosure of any existing conflicts.
