Why Action is Necessary

A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Commission”) at its meeting of September 10, 2026.

 

What Action Accomplishes

Allows for the Commission’s consideration of the proposed Ordinance amending the Broward County Code of Ordinances (“Code”).

Summary Explanation/Background

The proposed Ordinance amends Chapter 5 of the Code to eliminate transportation concurrency requirements related to roadway capacity, including concurrency districts, roadway concurrency reviews, transportation concurrency assessments, and road impact fees. The proposed Ordinance repeals obsolete transportation concurrency provisions, creates a new Section 5-182.1 confirming that applications submitted on or after the Ordinance’s effective date are not subject to regional road network adequacy review, and preserves the validity of previously issued development orders, permits, and certificates of adequacy. The proposed Ordinance also makes conforming amendments to related Code provisions governing development review procedures, action plans for transportation improvements, concurrency and impact fee credits, and development review requirements.

 

The Local Planning Agency held its public hearing on July 29, 2026, and recommended that the proposed Ordinance be found generally consistent with the Broward County Comprehensive Plan. The proposed Ordinance went before the Broward County Planning Council at its August 27, 2026, meeting, at which the Planning Council found the proposed revisions to be generally consistent with the Broward County Land Use Plan.
