Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided in the contract.

 

Pursuant to Broward County Procurement Code Section 21.27, Purchases from Other Government Contracts, the Director of Purchasing may purchase goods or services under any procurement contract held by a governmental agency or nonprofit entity, or the County may enter into its own contract with the vendor under the originating contract provided that the originating contract was competitively procured, authorizes such purchases, and the terms offered to the County do not materially deviate from the originating contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Connected Community Goal, “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

 

The Office of Economic and Small Business Development (OESBD) determined that no County Business Enterprise participation goal should apply to this solicitation based on OESBD’s review of the products and services provided through a pre-existing contract from a non-Broward County agency (Exhibit 2).

 

The contract provides for the purchase of 54 standard cutaway and minibus chassis transit vehicles under the competitively established Florida Department of Transportation (FDOT) Contract No. TRIPS-22-CA-MB-LF-NBC, for the Broward County Transportation Department (BCT). FDOT has authorized BCT to utilize the contract and purchase the vehicles at the cost of $203,435, including options, for each vehicle. The vehicles will be equipped to seat 18 to 22 passengers, in addition to two wheelchair positions, wheelchair lift, air purification systems, security cameras and they will operate on propane fuel. Of the 54 vehicles: 34 cutaways will be for contracted services, 5 will be for the expansion of community service routes and 15 units will be for the replacement of aging vehicles that have passed useful life (Exhibit 1).

 

FDOT Transit Research Inspection Procurement Service (TRIPS) competitively solicited the Request for Proposals (RFP) No. TRIPS-22-CA-MB-LF-RFP, on June 21, 2022, and the RFP opened on August 19, 2022. Five responses were received and on July 18, 2023, all five vendors were awarded through competitive negotiation: ABC Bus Inc; Florida Transportation System, Inc.; Matthews Bus Alliance, Inc.; Model 1, Inc. (Formerly Creative Bus Sales); and Nations Bus Corporation. The Participating Addendum will expire on the expiration of the FDOT Agreement or July 28, 2028, unless terminated earlier.

 

For this purchase, the order will be placed with Nations Bus Corp under Contract No. TRIPS-22-CA-MB-LF-NBC. BCT completed a price analysis for the cutaway vehicles provided by the Nations Bus Corp and the other vendors with larger vehicle size and lower fuel efficiency, and BCT determined that the best value for the desired customization (including fuel efficiency and size) is achieved by acquiring the vehicles from Nations Bus Corporation (Exhibit 3).
