Why Action is Necessary

Broward County Board of County Commissioners (“Board”) approval is required for the execution of the reimbursable agreement and transfers from reserve require board approval.

What Action Accomplishes

Execution of Amendment 001 provides additional funding to expand the “PEPORTS®” network to incorporate an additional horizontally-mounted current meter in the ICW at the Southport Turning Notch and updates the funding terms for the remainder of the agreement ending April 30, 2028 and provides additional one-time funding for an increase in the cost share per this amendment.

Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”

On April 5, 2016 (Item No. 10), the Board approved the substantial form of a Reimbursable Agreement between the U.S. Department of Commerce National Oceanic and Atmospheric Administration ("NOAA") National Ocean Service Center for Operational Oceanographic Products and Services and Broward County ("Prior Agreement"), to install and operate a Physical Oceanographic Real-Time System ("PEPORTS®") at Port Everglades to measure and disseminate observations and predictions of water levels and meteorological wind conditions used by mariners to navigate safely.

PEPORTS® is a NOAA program that supports safe and cost-efficient navigation by providing ship masters, pilots, and other users with accurate real-time information required for safe vessel loading and transit and to avoid groundings and collisions.

On April 18, 2023 (Item No. 8), the Board approved a new Agreement to provide funding to maintain a water level station and current measurement stations at Port Everglades through April 30, 2028. As a part of this agreement, current measurement stations were to be installed at three locations along the Port Everglades Entrance Channel. Each location included an Acoustic Doppler Current Profiler (“ADCP”) to measure currents (horizontally mounted or buoy mounted); a data collection platform; a rechargeable battery; a solar panel or AC charger; and a telemetry system (radio/modem/antenna for telephone modem). Two buoy-mounted ADCPs were installed on existing U.S. Coast Guard floating aids to navigation, and the third current meter is scheduled to be installed on a U.S. Navy buoy south of the Entrance Channel before the end of this year.

This Amendment 001 to the Agreement incorporates funding for the equipment, installation, operation, and maintenance of one new horizontally mounted current meter to be installed in the Intracoastal Waterway (“ICW”) at the northeast corner of the recently expanded Southport Turning Notch identified by the Port Everglades Pilots Association as a critical location for having current data when maneuvering large container ships in and out of Southport.

NOAA is responsible for the design, installation, management, equipment, performance, operation, data, maintenance, enhancement, and repair of the PEPORTS®, with funding provided by the County over the five-year term of the Agreement.

Amendment 001 has been reviewed and approved as to form by the Office of the County Attorney. Amendment 001 is in a form required by NOAA and does not include standard County terms. The amendment is completing final review within NOAA before execution, and the Board will be notified through the Monday Night Memo if the amendment is not executed by NOAA prior to the meeting.
