MOTION TO APPROVE Temporary Access Agreements for the Broward County Shore Protection Project between the City of Pompano Beach, the Town of Lauderdale-by-the-Sea, the City of Fort Lauderdale, the City of Dania Beach, the City of Hollywood, and the City of Hallandale Beach and Broward County to allow temporary access onto the beach and temporary staging of equipment for work required by permits issued by the Florida Department of Environmental Protection; authorize the County Administrator and Clerk to execute same; and authorize the County Administrator, subject to review and approval for legal sufficiency by the County Attorney’s Office, to execute amendments to the Agreements that do not impose additional financial obligations on the County. Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the County Commission’s Goal of Resilient Community of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”
Background:
The Broward County Shore Protection Project (“Project”) includes both Segment II and Segment III beaches and ensures that beaches are a sufficient width for the protection of upland infrastructure, recreational use, and wildlife (such as sea turtle nesting). The Project supports tourism and the local economy and provides critical habitat to marine life. Segment II of the Project is located along the central portion of the Broward County shoreline, between Hillsboro Inlet and Port Everglades Inlet. It is 4.9 miles in length and fronts the Town of Lauderdale-by-the-Sea and the cities of Pompano Beach and Fort Lauderdale. Segment III of the Project is located along the southern portion of the Broward County shoreline, between Port Everglades Inlet and the Broward County/Miami-Dade County line. It is 8.1 miles in length and fronts the Dr. Von D. Mizell-Eula Johnson State Park and the cities of Dania Beach, Hollywood, and Hallandale Beach.
The Florida Department of Environmental Protection (FDEP) issued the County permits to conduct the Project. The permits require beach tilling to ensure that the newly placed sand is sufficiently loosened to facilitate successful sea turtle nesting. Beach tilling must be done for three years post-construction so long as placed material remains on the beach. Both Segment II and Segment III recently received sand as part of federal Flood Control and Coastal Emergency projects. Segment II received approximately 400,000 cubic yards of sand from 2021-2022. Segment III received approximately 900,000 cubic yards of sand from 2021-2024. Per the FDEP permits, beach tilling is required in Segment II in 2025 and in Segment III in 2025-2027. These Temporary Access Agreements are necessary to allow temporary access onto the beach from designated access points and staging of tilling equipment.
It is expected that the municipalities will approve these agreements on January 8 (Hallandale), January 14 (Pompano, Lauderdale-by-the-Sea, Dania), January 22 (Fort Lauderdale), and February 5 (Hollywood). County staff will advise the Board if any municipal approvals do not occur.
The Agreements include a right to terminate by either Party with at least 60 calendar days advance written notice to the other Party. The Agreements have been approved as to form by the Office of the County Attorney.

Fiscal Impact/Cost Summary
There is no fiscal impact associated with approval of this item. Funds for tilling activities are included in the beach program’s portion of the board-approved capital budget and are also eligible for partial state and federal reimbursement.
