Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
Broward County (“County”) entered into a license agreement in 1989, and a First Amendment in 1994 (together, the “Current Agreement”), with the Florida Live Steamers and Railroaders, Inc., for the installation, operation and maintenance of a one and a half scale model railroad, approximately 5,000 feet in length, around a specified lake within Tradewinds Park (the “Park”). The Current Agreement allows for unlimited five- year renewals at the licensee’s option, and termination by either party upon 30 days’ advance notice.
Under the Current Agreement, the licensee has cleared the site for track installation, laid down roadbed, obtained all necessary permits for electrical/structural improvements, and provided ongoing maintenance and upkeep to the designated site. No license fee is paid to the County under the Current Agreement. The licensee is a 501(c)(3) nonprofit corporation. All members of this organization are volunteers conducting a minimum of two weekends each month for operations of the model railroad facility. There are no admission fees to the site for the general public, except for standard Park entrance fees on weekends and holidays.
The Current Agreement is currently set to expire on February 28, 2024, unless extended. This item would allow the County Administrator to approve and execute an Amended and Restated Agreement, which would include updating the licensee’s legal name to Tradewinds & Atlantic Railroad, Inc. and incorporating the County’s current terms and conditions.
