Why Action is Necessary

Approval of the Board of County Commissioners is required to sell surplus property pursuant to Section 125.35(2), Florida Statutes, and Broward County Administrative Code, Section 6.122(f).

 

What Action Accomplishes

Disposes of unused surplus real property and eliminates potential liability and maintenance costs for the County.

February 25, 2020 - Item No. 40 - The Board of County Commissioners declared this parcel of real property and one other parcel of real property surplus to the County’s needs.

December 1, 2020 - Item No. 44 - The Board of County Commissioners authorized the Real Property Section to manage the sale of this parcel of real property and the sale of two other County-owned parcels of real property.

 

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On February 25, 2020 (Agenda Item No. 40), the Board of County Commissioners of Broward County, Florida (“Board”) declared this parcel of real property identified by Folio Number 5042-05-08-0710, approximately 3,845 square feet, and located at the corner of Northwest 8 Street and Northwest 25 Avenue in the Broward Municipal Services District (the “Property”), as surplus to the County’s needs based on its insufficient size and shape to be issued a building permit and is of use to only one or more adjacent property owners due to its size, shape, location, and value; and authorized the Real Property Section to send notice to adjacent property owners of the County’s intent to sell the Property and manage the sale of the Property in accordance with Florida Statutes, Section 125.35(2) or if no bids are received, advertise the Property for sale and manage the sale of the Property in accordance with Florida Statutes, Section 125.35(1).

 

As required under Florida Statutes, Section 125.35(2), on August 25, 2020, notice of the County’s intent to sell the Property was sent to both adjacent property owners.  Neither adjacent property owner notified the County of any desire to purchase the Property.  After the Board authorized the Real Property Section to manage the sale of the Property on December 1, 2020 (Agenda Item No. 44), the Real Property Section placed the Property for sale on the County’s Surplus Properties website, and on December 4, 2025, the County received the Purchaser’s $10,000 offer for the Property.

 

All applicable documents have been reviewed and approved as to form by the Office of the County Attorney.
