Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that includes a rejection of apparent low bidder.

Provides all labor, tools, equipment, and materials to inspect, test, maintain, calibrate, and repair existing electrical power systems and related equipment.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) determined that this solicitation should have a County Business Enterprise (CBE) participation goal of 10%. Mills Electric Service, Inc. committed to 10% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).
The contract provides for all labor, tools, equipment, and materials to inspect, test, maintain, calibrate, and repair existing electrical power systems and related equipment.
This procurement carries a 50% performance and payment guaranty. The vendor has provided a bid guaranty obligating the vendor to provide requisite performance and payment guaranty upon notice of award.
The contract includes allowances in the amount of $6,937,000, including $3,300,000 in Percentage Discount from List price (published catalog/price list), for the initial term. Expenditures under the allowances (other than Percentage Discount from List price) must be approved by the Contract Administrator and will be reimbursed at the vendor’s actual cost without mark-up (Exhibit 1).
The Director of Purchasing determined the apparent low bidder, Electricians On Call Corp, to be non-responsive to bid bond requirements.
The Director of Purchasing determined 4 Best Business Corp (4BB), the second low bidder, to be non-responsible based on Water and Wastewater Services (WWS) non-concurrence. WWS reviewed the vendor’s experience; 4BB did not provide references that included industrial electrical systems or projects within the corrosive and humid municipal environments equivalent to WWS (Exhibit 3).
The Director of Purchasing determined the third low bidder, Solarium Energy Corp, to be non-responsible based on non-compliance with the 10% CBE goal requirement (Exhibit 2).
The Director of Purchasing determined DES Hat Electric Joint Venture LLC (DES Hat), the fourth low bidder, to be non-responsible as it materially modified its bid after the solicitation’s close date. Pursuant to Broward Code Procurement Code, Section 21.40(b)(4), Determinations of Responsiveness and Responsibility, information shall not be considered if it materially alters the information provided in the vendor’s original response to the solicitation; DES Hat replaced its joint venture partner after the solicitation’s close date.
The Director of Purchasing determined Phase 2 Electric LLC DBA Wesworth Electric (Wesworth), the fifth low bidder, to be non-responsible to the solicitation based on WWS non-concurrence. WWS reviewed the vendor’s experience; Wesworth did not provide references that included industrial electrical systems or projects within the corrosive and humid municipal environments equivalent to WWS (Exhibit 3).
WWS reviewed the bid submitted by Mills Electric Service, Inc. and concurs with the recommendation for award (Exhibit 4).
A County vendor performance evaluation was completed for Mills Electric Service, Inc. within the last five years; Mills Electric Service, Inc. has an overall performance rating of 3.95 out of possible rating of 5.0. Copies of the performance evaluations are available upon request.
The Purchasing Division reviewed the prices submitted by the lowest responsive, responsible bidder, Mills Electric Service, Inc., and determined that prices submitted are fair and reasonable in comparison to a current County contract for the same services (Exhibit 5).
The bid was advertised on November 4, 2025, and opened December 12, 2025; seven bids were received with no declinations (Exhibit 1).

Expenditures to date: $4,859,993.
Incumbent: Miller Electric Company, Contract Numbers BLD2122670B1_3 and BLD2122670B1_4 Electrical Maintenance and Repair, Contract Term: January 1, 2022 through December 31, 2023, First Renewal: January 1, 2024 through December 31, 2025, 90-Day Extension: January 1, 2026 through March 31, 2026. Expenditures to date: $ 7,701,812.
The Recommendation for Award was posted on the Purchasing Division website on March 25, 2026. No protest was filed against this procurement.
Mills Electric Service, Inc.’s bid validity expired on April 11, 2026, and Mills Electric Service, Inc. has agreed to extend it through August 9, 2026.
The contract consists of the County’s solicitation and the vendor’s response.
The initial contract period begins on the date of award.
