Why Action is Necessary

Pursuant to Broward County Procurement Code, Section 21.56, each construction contract shall have an initial amount budgeted for change orders equal to 5% of the total contract amount. Broward County Board of County Commissioners’ approval is required to increase the change order contingency allowance when it exceeds 5% of the original contract amount or $100,000, whichever is less.

Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal for this Agreement of 30%. As of February 24, 2023, Man-Con Incorporated (MCI) has been paid $1,070,442 with $335,084 paid to CBE firms, yielding 31.30% CBE participation (Exhibit 1).

 

On March 21, 2022, the Director of Purchasing approved the Agreement between Broward County and MCI in the amount of $1,106,510, which included a 5% or $55,326 change order allowance. This contract was executed on April 26, 2022. (Exhibit 2)

 

Two change orders have been processed to date for a total change order amount of $52,060 and a total amended contract amount of $1,158,570. (Exhibit 3)

 

During this project, unforeseen costs arose associated with emergency work on NE 22nd Avenue Force Main Phase 2 located in the City of Lighthouse Point. Specifically, MCI cut into an active force main that was shown as abandoned in designs provided to the County by a third-party and a sewer spill occurred. This spill resulted in a road closure and additional emergency work including but not limited to sewage cleanup, bypass and construction of a modified force main tie-in connection, abandonment, as well as additional restoration. The emergency work was conducted in a timely manner to avoid additional sewer spills, residential complaints, and additional costs to the County. This project is now complete, however, the emergency work required an additional amount of $149,977 in costs. This amount is required to close out the project.

 

If approved, this item will authorize the Contract Administrator or designee to execute a change order that authorizes a change in contract price sufficient to close out the project.
