Why Action is Necessary

What Action Accomplishes

Approval of Motion A enables the reallocation of funds to maximize the provision of services that address the multifaceted needs of individuals and families experiencing homelessness in Broward County and best meet the community’s needs using a collaborative, comprehensive, and integrated approach.

 

Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The funding increases will ensure the most effective and efficient use of currently budgeted resources for (i) street outreach, (ii) permanent supportive housing, and (iii) domestic violence emergency shelter and supportive services. It will also allow the service providers to address the current needs of the clients served.

 

On September 16, 2025 (Item No. 6), the Commission approved the funding recommendations for Fiscal Year 2026 for agreements with nonprofit organizations to provide various services. The Housing Options, Solutions, and Supports Division (“HOSS-D”) completed its midyear assessment of how funding is being utilized under all agreements. The midyear assessment revealed utilization patterns demonstrating a need for increased funding for the service provider agreements listed in Exhibit 1. HOSS-D recommends increasing funds to the specified agreements to meet the current community needs.

 

Upon Commission approval, the Human Services Department Director or Deputy Director will execute the contract adjustments, increasing each agreement’s maximum funding amount as set forth in Exhibit 1. Commission approval is required because the requested increases in funding exceed the threshold authorized by the terms of the agreements.

 

HOSS-D’s recommendation is supported by a letter from the Homeless Continuum of Care Board (Exhibit 2).

 

Retroactive approval is requested to allow reimbursement to the providers for services already rendered to eligible clients.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(7)(a), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 3 and constitute full disclosure of any existing conflict.
