Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Florida Department of Transportation (“FDOT”) is planning improvements to the Pat Salerno Drive interchange with the Sawgrass Expressway to accommodate traffic movements to and from the north and the south.
On May 26, 2026 (Agenda Item No. 39), the Board of County Commissioners adopted Resolution No. 2026-138 approving the conveyance of three (3) parcels of County-owned property to FDOT for right-of-way purposes in connection with Pat Salerno Full Interchange. The County has since conveyed two of the three parcels to FDOT. The one parcel pending conveyance (i.e., Parcel 105) is encumbered in part by a perpetual signage easement. Staff is actively negotiating a partial release with the party that benefits from the platted signage easement that would allow conveyance of Parcel 105 as originally approved. To avoid project delays, during its review of the design plans for the new interchange, FDOT determined that a smaller right-of-way footprint would accommodate the design plans. FDOT requested that the legal description of Parcel 105, be revised to reflect the reduced footprint (i.e., excepting the area subject to the signage easement) and conform to the updated design plans. It is expected that the excepted area will be conveyed to FDOT once the partial release is obtained.
The proposed Resolution authorizes the conveyance of Parcel 105 to FDOT using the revised legal description, pursuant to Section 125.38, Florida Statutes, and Section 6.19(f) of the Broward County Administrative Code.
The Resolution and Quitclaim Deed have been reviewed and approved as to form and legal sufficiency by the Office of the County Attorney.
This item is being added as a supplemental item to the September 10, 2026, agenda because the circumstances necessitating submission arose after the deadline. Deferral to a subsequent meeting would have an impact on the project’s development timeline.
