Why Action is Necessary

An amendment to an ILA for the Broward Redevelopment Program (“BRP”) requires approval by the Board of County Commissioners (“Board”).

Approves the Second Amendment to an ILA between the County, the City of Fort Lauderdale (“City”), and the Fort Lauderdale Community Redevelopment Agency (“CRA”), extending the term by one year to terminate on December 31, 2025.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The item supports the Board’s value: “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward's lower and middle class.”

 

On March 5, 2019, the Board approved a motion (Agenda Item No. 7) authorizing the County to enter into an ILA with the City and the CRA for the construction of a Complete Streets Project on NE 4th Avenue, from Sunrise Boulevard to NE 13 Street, in the area depicted in Exhibit 3, as part of the Broward Redevelopment Program (BRP) in the amount of $1,000,000.  The original ILA provided for a termination date of December 31, 2022, which was amended by the Board on November 15, 2022, (Agenda Item No. 30) and extended the ILA termination date to December 31, 2024, to enable completion of the project.

 

County staff received a letter dated December 4, 2024, (Exhibit 2) indicating that the Complete Streets project is substantially complete except for the lighting component of the scope of work.  The City reported delays and resource limitations but has committed the CRA funds necessary to complete the lighting, which is in the bidding phase and estimated to be complete in July 2025. Therefore, the City has requested an additional one year extension of the ILA to complete the last of the remaining scope of work. Although the lighting component will be paid through CRA funds, the entire scope of work included in the ILA must be complete before the $1,000,000 in BRP funds can be disbursed to the City.  The project is in compliance with the public purpose of removing blighting conditions in the Central City CRA area, as well as further the City’s Vision of becoming a connected and multimodal community.  The Office of the County Attorney prepared the Second Amendment (Exhibit 1) that extends the ILA term for one year from December 31, 2024, to December 31, 2025.
