Board of County Commissioners' approval is required to convey and accept an interest in real property pursuant to Florida Statutes, Section 125.37, and Broward County Administrative Code, Section 6.23.
What Action Accomplishes
Provides neighborhood access to the Charlotte Burrie Civic Center in Pompano Beach through a portion of the County-owned lift station property in exchange for a portion of property east of the lift station providing space for future expansion of services as needed.

Summary Explanation/Background
COUNTY ADMINISTRATION/REAL PROPERTY SECTION AND THE WATER WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The County-owned property located at 2600 NE 16th Avenue in Pompano Beach is identified by Folio Number 4842-2408-0610 (“County-owned”). This parcel is currently utilized as Sewer Lift Station 424. The County acquired the parcel in 1968 from Broward Utilities.
On June 23, 2020, the Pompano Beach City Commission approved a Contract for Sale and Purchase with Pompano Ford Lincoln, Inc. for the acquisition of the parcel identified as Folio Number 4843-1900-0240 with the purpose of providing neighborhood access to the Charlotte Burrie Civic Center in Pompano Beach (“City-owned”). The Contract made the closing contingent upon the County agreeing to the use of the southern 45.5 feet of the County’s property for the construction of an access road to connect public roadway NE 26th Street to the City’s property. The County property currently has a 15-foot wide ingress and egress easement.
On July 28, 2020, the Pompano Beach City Commission approved the terms of a proposed Exchange Agreement authorizing the exchange of the northwest 24 feet of the City-owned property for the southern 45.5 feet of the County-owned parcel. The usable size of the parcels being exchanged is identical once the 15-foot ingress and egress easement in favor of the adjacent users is removed from the County-owned parcel.
All documents have been reviewed and approved as to form by the Office of the County Attorney.
